CG 00 01: Commercial General Liability Coverage Form (Occurrence)

CG 00 01 is the ISO commercial general liability coverage form, occurrence version, and the base that every CG endorsement in this library modifies. Pikorua Security checks endorsements against it: the "insured contract" definition that keeps indemnity obligations insured, the Other Insurance condition that decides whose policy pays first, the transfer of recovery rights condition that waivers modify, the aggregate structure that per project endorsements change, and the products-completed operations hazard that marks where ongoing operations coverage stops.

Edition history

The edition stamp in the endorsement footer identifies the exact wording. Pikorua Security reads it on every page and compares it with the editions your contract accepts.

CG 00 01 editions and what changed
EditionWhat changed
11 85First edition of the simplified CGL introduced in 1986, replacing the comprehensive general liability policy. Introduced the "insured contract" definition and paired the occurrence form with the claims-made CG 00 02.
10 01Clarified that electronic data is not tangible property and added an electronic data exclusion. Released in the same cycle that introduced CG 20 37 10 01 for completed operations additional insureds.
12 04 and 12 07Interim editions still seen on long-running programs. A forms schedule showing one of these should prompt a check that the additional insured and primary wording was updated alongside the base form.
04 13The base form behind most policies in force. Its own changes centered on liquor liability wording; the construction impact of the 2013 cycle landed in the companion additional insured endorsements and the new CG 20 01.
12 25LatestISO's newest multistate edition. Carriers adopt it state by state on their own timetables, so expect forms schedules mixing 04 13 and 12 25 base forms during the transition.

Section I of CG 00 01 holds three coverages. Coverage A pays damages because of bodily injury and property damage caused by an occurrence during the policy period. Coverage B covers personal and advertising injury offenses. Coverage C pays medical expenses regardless of fault. Supplementary Payments pay defense costs and related expenses in addition to limits, including, when stated conditions are met, the defense of an indemnitee whose liability the named insured assumed in an insured contract.

Section II, Who Is An Insured, defines who is covered before any endorsement adds anyone. Section III sets the limits: each occurrence, general aggregate, products-completed operations aggregate, personal and advertising injury, damage to premises rented and medical expense. Section IV holds the conditions and Section V the definitions. Most compliance work happens in those last two sections.

The claims-made counterpart is CG 00 02. The ACORD 25 shows which one applies with the occurrence or claims-made box, and Pikorua Security confirms it against the forms schedule, because a claims-made CGL changes the completed operations analysis entirely.

The provisions Pikorua Security checks endorsements against

Insured contract. Exclusion b removes liability assumed in a contract, except liability assumed in an insured contract. Paragraph f of the definition covers that part of any other contract or agreement pertaining to the named insured's business under which it assumes the tort liability of another party to pay for bodily injury or property damage to a third person. That paragraph makes a subcontractor's indemnity of the GC insurable. It is the target of CG 21 39 (which deletes it) and CG 24 26 (which ties it to the named insured's fault), and railroad work within 50 feet is carved out of it until CG 24 17 restores it.

Other Insurance. The policy is primary unless it is excess, and it is excess over any other primary insurance available to the named insured for which it has been added as an additional insured. When two primary policies apply, they share by equal shares or by limits. An additional insured's own policy can therefore be asked to contribute, which is why exhibits require CG 20 01 primary and non-contributory wording.

Transfer of Rights of Recovery Against Others to Us. After paying a loss, the insurer takes the insured's recovery rights, and the insured must do nothing after loss to impair them. A pre-loss contractual waiver is generally consistent with that wording, but contracts still require CG 24 04 or blanket waiver wording so the waiver in favor of the scheduled parties is explicit. Nonrenewal notice to the first Named Insured is a separate condition; cancellation lives in IL 00 17.

Products-completed operations hazard and the aggregates. Injury after work is completed or put to its intended use falls within this hazard, which is where ongoing operations additional insured coverage ends and CG 20 37 must pick up. The general aggregate applies per policy unless CG 25 03 (per project) or CG 25 04 (per location) changes it.

Edition history

The 11 85 edition launched the simplified CGL in 1986 and introduced the insured contract definition. The 10 01 edition addressed electronic data, stating it is not tangible property and adding an electronic data exclusion, in the same cycle that introduced CG 20 37. The 12 04 and 12 07 editions followed. The 04 13 edition is the base form behind most policies in force; the construction impact of the 2013 cycle landed in the companion additional insured endorsements and the new CG 20 01 rather than in the base form itself.

ISO has since published a 12 25 edition. Carriers adopt new editions state by state on their own schedules, so forms schedules mixing 04 13 and 12 25 base forms will be common for a while. The edition matters because endorsements are filed to work with a specific base form; an older endorsement attached to a newer base form can leave wording mismatches.

What to require or prohibit in the contract

Require occurrence-form CGL on ISO CG 00 01 or a form at least as broad, with the products-completed operations aggregate maintained for the completed operations period. If a vendor's only option is claims-made, require a retroactive date no later than the start of work and an extended reporting period or continuous coverage through the completed operations period.

  • Require: CG 00 01 or equivalent occurrence form, the insured contract definition unmodified, and a per project aggregate by CG 25 03 on construction work.
  • Require: CG 20 01 to override the Other Insurance condition in favor of the additional insureds.
  • Prohibit: CG 21 39, CG 24 26, CG 21 44 limitations to other premises, and carrier forms that narrow Who Is An Insured or delete Supplementary Payments for indemnitees.

How Pikorua Security verifies the base form

Pikorua Security reads the policy forms schedule when the vendor or broker uploads it, along with the ACORD 25 occurrence or claims-made selection. The validator records the base form number and edition, flags carrier proprietary forms for a wording comparison against CG 00 01, and checks that every endorsement on file is compatible with that base form.

Endorsements that modify the insured contract definition, Who Is An Insured or the Other Insurance condition are scored against the CG 00 01 baseline, so a risk manager sees exactly what changed and which contract paragraph it affects, instead of a generic "policy reviewed" checkmark.

Findings Pikorua Security raises on CG 00 01

6 checks
  1. Flag 01

Claims-made CGL (CG 00 02 or carrier equivalent) accepted without a retroactive date or extended reporting terms covering completed operations.

  2. Flag 02

Carrier proprietary coverage form substituted for CG 00 01 with a narrower insured contract definition buried in Section V.

  3. Flag 03

Products-completed operations aggregate lower than the contract requires, or already eroded by claims from other projects.

  4. Flag 04

Forms schedule shows CG 21 39 or CG 24 26 modifying the insured contract definition, undercutting indemnity coverage.

  5. Flag 05

No CG 20 01, so the Other Insurance condition leaves the additional insured's own policy exposed to contribution.

  6. Flag 06

Policy-wide general aggregate shared across every project the vendor works on, with no CG 25 03 per project endorsement.

Insurance exhibit clause

CG 00 01: CGL occurrence form

Commercial General Liability. Subcontractor shall maintain commercial general liability insurance on ISO occurrence form CG 00 01 (04 13 or later edition) or a form providing coverage at least as broad, with limits of not less than $1,000,000 each occurrence, $2,000,000 general aggregate (applying per project by ISO CG 25 03 or equivalent), $2,000,000 products-completed operations aggregate, and $1,000,000 personal and advertising injury. Coverage shall include contractual liability for Subcontractor's indemnity obligations under this Subcontract as an "insured contract," without modification by ISO CG 21 39, CG 24 26 or similar endorsements, and shall include Supplementary Payments for the defense of indemnitees. Products-completed operations coverage shall be maintained for not less than three (3) years after final completion. Claims-made forms are not acceptable without Contractor's written approval.

Have counsel conform the clause to the governing law of your contract. Pikorua Security verifies insurance documents against the requirements you set; it does not provide legal advice and does not sell, bind or underwrite insurance.

When the claim arrives

Tender defensibility

Every tender analysis returns to the base form. Coverage counsel reads the insured contract definition to decide whether the indemnity is insured, the Other Insurance condition to decide priority, and the products-completed operations hazard to decide whether ongoing operations coverage applies. Having the forms schedule and base form edition verified and stored next to the endorsements means the tender packet answers those questions with the actual policy language rather than a certificate's summary of it.

Frequently asked questions

What is the difference between CG 00 01 and CG 00 02?
CG 00 01 is the occurrence form: it covers injury or damage that occurs during the policy period, whenever the claim is made. CG 00 02 is claims-made: it covers claims first made during the policy period for injury after the retroactive date. Construction contracts usually require occurrence coverage because completed operations claims arrive years after the work.
What is an insured contract?
A defined term in CG 00 01 listing the contracts whose assumed liability stays covered despite the contractual liability exclusion: leases of premises (except fire damage indemnity), sidetrack agreements, certain easement or license agreements, municipal ordinance indemnities, elevator maintenance agreements, and the part of any other business contract in which the insured assumes another party's tort liability.
Is CG 00 01 primary?
It is primary unless the Other Insurance condition makes it excess, including where the named insured is an additional insured on another policy. Primary policies share by equal shares or by limits unless an endorsement such as CG 20 01 changes that.
Which CG 00 01 edition should a contract require?
Most contracts specify CG 00 01 "or equivalent" and require the 04 13 or later edition of the companion endorsements. Naming a base form edition matters less than prohibiting the endorsements that narrow it.
